I just came from the General Membership Meeting of Calchess.
Elizabeth Shaughnessy was re-elected President. The new treasurer is
Richard Koepcke. Richard Peterson did not show up. The actual amount
stolen by Richard Peterson is about $30,500. When Eric Hicks took
over as Editor of The California Chess Journal, from Frisco Del
Rosario, the magazine went from a bi-monthly publication to a
quarterly publication, so it's true: new Calchess members were
promised six issues, and got less. The Board plans on compensating
those members. There was nobody there who had the slightest sympathy
for Peterson. He was generally condemned as a thief. Calchess may
have a case against the bank, since it released funds in the absence
of two signatures, which was required.

From previous postings, it would appear that Richard Peterson
appointed himself to enforce laws which may or may not exist.

He apparently determined, on the basis of facts not yet stated, that
CalChess, a voluntary association, was not a legal organization in
California. He apparently determined that funds in the custody of
the Treasurer could be withdrawn by him in order to act in favor of
the claims of certain creditors, disregarding the rights of others who
would have residual claims such as pre-paid memberships. Such matters
are ordinarily determined by courts of competent jurisdiction.

Certainly the bank has an obligation to make good, and it would be
good if the bank could have the depository bank issue a debit memo in
order to return the money to the bank it was taken from. If a lawsuit
is necessary, the bank can certainly bring the suit on the basis of
fraud.

If two signatures are necessary in order to withdraw funds, someone
should ask the bank if they can provide checks that have two signature
lines.

All of his arguments so far have centered on the Calchess's failure to
perform -- not on his right to remedy the failure with vigilante
action. How can he possibly assert such a right? The Treasurer
seizes the assets, keeps them in his personal possesion with the
promise to set up a rump organization to disburse them? Jesus.

Good point. The bank has the resources and background knowledge to
take action, if it's warranted.

It seems amazing to me that Calchess hasn't set any of these legal
wheels in motion.
