I have filed a lawsuit against Truong, Polgar, USCF et al

The case has been filed in the United States District Court for the
Southern District of New York at 500 Pearl Street, New York NY 10007.

The case number is 07 CIV 8537

The judge is Judge Denny Chin

The Magistrate Judge is Judge Frank Maas

The suit seeks to overturn the results of the 2007 USCF Election on
the grounds of election fraud and to reinstate the directors who were
thrown out in that election until a new election can be held. The
complaint alleges that defendants Susan Polgar and Paul Truong
impersonated Sam Sloan and sent out three thousand obscene and
pornographic newsgroup postings during the election campaign in order
to discredit Sloan and get themselves elected so as to take over the
USCF Finances.

The papers and pleadings filed in the Southern District of New York
can be downloaded at the following addresses:

up is handled in this same unorthodox manner. I had hoped the EB had
hired an expert by this time an was well down the road to settling
this issue. I was under the impression that was what was taking place.
from the posts today, I find the USCF has not even hired that
expert.Yet others tell me ,some outside the USCF have two reports
already from respected experts. Why doesn't the USCF check these
experts out and if they are respected in their field use these
reports, instead of paying a 3rd expert. it would seem that all
involved would be interested in clearing up this whole situation as
quickly as possible.
The answer is the same as I answered in other threads that raise this
subject. We (the USCF Executive Board) are going to remain deliberate
and deliberative in our actions. We have a course of action, but this
isn't speed chess. Doing it right is more important than doing it
quick.

I have yet to see a report from these other so-called experts. Until
I see something in writing putting their reputation (and perhaps their
financial well-being) on the line, it's all just assertion.

The First Mottershead report came out on September 26, 2007. We then
learned that he had already communicated his findings privately to
Bill Goichberg and Bill Hall one week earlier. Then Mottershead was
told to make a more complete report, which he did in a record time of
only about one week. Meanwhile, I had filed my lawsuit.

Then, you were not willing to accept the Mottershead Report that you
had asked him to do, so you said that you were going to retain an
independent expert to review his findings.

That was nearly one month ago. Now we learn that you have not retained
the independent expert yet. You state, "we are going to remain
deliberate and deliberative in our actions."

But you only have until November 20 to file a responsive pleading to
my lawsuit. How much longer are you going to "deliberate" before
doing anything?

Just what this country needs. Another frivolous lawsuit. I suppose
you will sue your dry cleaners for your missing pants for 60 million I
suppose.
