A judge, who is far removed from the hatreds and jealousies of rgcp, will render a decision. Sam's case has evident merit. The issue will be whether a judge will overturn a major organizational decision -- a horrendous intervention and enormous sanction -- based on the Board violating its own bylaws. Secondly, he claims that the Sloan suit has been tossed. It has not been tossed. It is going stronger than ever. Thirdly, an order to show cause is not a notice of motion., I have to wonder if Dondo is really the lawyer he claims to be. Before the judge signed the order, he reviewed it for legality. By the way, the judge's law clerk is an author of law books, which is rare and unusual. Fourthly, it is Dondo who is costing the federation money by expressing views about New York Law when he is not licensed to practice in New York, which will lead his political allies to have a false sense of security and indeed arrogance which will cause them to fall a lot harder if and when I win this case. Imagine that. While it is without prejudice, meaning he can come back, he also included this paragraph: "Based on the complex nature of the issues involved, this Court requires, pursuant to CPLR §1101(b), that this movant submit a certificate of an attorney stating that the attorney has examined the action and believes there is merit to the moving party's contentions. The attorney should address issues such as standing and the appropriateness of the remedies requested (including the issuance of an injunction against an official of another state)." These are sufficiently complex issues that no lawyer worth his salt would file such an affidavit without some significant research.
