Gordon? I want to help you with your problem (not my problem) on drug
testing. Members of the General Assembly are unlikely to be drug
tested. I don't have to take the damn thing. I'll help you, but you
must understand that the USCF has ****ed our national chess
association, to the tune of 7,000 dollars.

Chapter 17 - Final Settlement of Disputes at the Court of Arbitration
for Sport

17.1. Nothwithstanding any provisions to the contrary in this Statute,
FIDE hereby subscribes to the final settlement of any dispute directly
or indirectly related to chess in its whole or partial practice, be it
commercial or relating to the practice and development of chess or a
dispute following a decision by FIDE, to be sent to the Court of
Arbitration for Sport in Lausanne without recourse to any other court
or tribunal, as earlier subscribed to by FIDE on 11 October 1995.

17.2. For all practical purposes, the practise of the game of chess in
all its ramifications is fully recognised as sport by the International
Olympic Committee at the IOC session in Seoul, Korea in June 1999 and
therefore any form of practice of the game of chess and any decision
thereon by FIDE or any form of activity relating thereto either
directly or indirectly falls within the definition of sport.

17.3. The settlement of all disputes under Article 17.1 above shall be
applicable to acts performed by :

FIDE as an Organisation
FIDE Office bearers
Member Federations, their clubs and individual players
Sponsors
Any person or body with whom FIDE has entered into any form of
contractual arrangement either directly or indirectly related to Chess

17.4. The Decision of the Court of Arbitration for Sport shall be
final and binding on the parties.

Do you understand the legal issues? We don't need to be FIDE rated.
FIDE has no legal right to dicate to use anything they aren't dictating
to the USA. I am going to push around some snobs at FIDE, becasue they
have illegally kept us out of the 2006 World Chess Chapionship.

The reason I am the President of the Charleston Chess Association is
because I have the money to get the fedetaion into FIDE. So, I really
don't need a FIDE rating.

Chessplayers have a very hard time understanding the law, or business
issues. This really pretty straight forward. I am rich, St kitts and
Nevis has a right to join FIDE, and we are going join. If you don't
like that, I suggest you make a several million dollars and try to stop
me.

The point of this for me is R.C.G.P. is try to understand what good I
can do within FIDE. So far, I think I have very little chance of making
any positive impact on FIDE.

In the end of this, what I am doing is good for chess, and it appears
to me that most people really don't give a ****. Therefore, I am going
to do exactly what I want to do.

Yes, I and several other players would have qualified. FIDE my try to
say at their next secret Presdiential Board meeting (the date is
secret, it is unclear to me if they meet in 90 days, or later on. Only
the Presdiential Board can admit me. So, the attorney has to fax FIDE a
letter, and it really doesn't matter what she says, the real answer
can't come for 90 more days.

Full admission (voting for FIDE President) comes on approval of the
General Assembly. I think that it will be a struggle to obtain a vote,
but it is a legal inevitiblity. The next meeting of the General
Assembly isn't for 18 months, so most of the duties of FIDE Delegate
are purly cermonial in nature.

155 votes or 156 in the General Assembly, it really isnt' that much
power.

St Kitts and Nevis has a right to particiapte in the world chess
championship. The law is pretty straighforwd. The Olympic Charter,
article 5, guarentees ALL NATIONS the right to particiapte.

If FIDE does as you wish, and abolishes drug testing, then is would be
easier to throw me out, as I would have less of a legal claim. I think
that as long as FIDE stays subject to the Swiss courts, St kitts and
Nevis will have a voting delegate as long as I live in FIDE.
