200802686 Date 2008-02-01 From SusanPolgar Status Standard Release Release Date 2008-02-06 Subject Committee motion pertaining to Paul Truong's Board Status * To: randybauer2300@xxxxxxxxx, Chessoffice@xxxxxxx, joel@xxxxxxxxxxxxxxxxxxxxxxx, CHESSJOEL@xxxxxxx, randallhough@xxxxxxxxx, JABerryCG@xxxxxxx, bhall@xxxxxxxxxxx * Subject: Committee motion pertaining to Paul Truong's Board Status * From: SusanPolgar@xxxxxxx * Date: Fri, 1 Feb 2008 18:56:24 EST * Cc: Paultruong@xxxxxxx, USCF BINFO System, queencapa@xxxxxxx, jbrown@xxxxxxxxxxxxx, karl@xxxxxxxxxxxxxxxxxxx * Delivered-to: USCF BINFO Systemxxxxxxxxx * Delivered-to: USCF BINFO System You have no sufficient evidence for any of these charges. After more than four months of investigation and wasting tens and thousands dollars of USCF money, you still have nothing. The evidence which was sent to Mr. Kronenberger was more than enough to show that the report had the wrong conclusion. - The board majority refused to allow our experts to examine the data for more than 4 months. - The board majority refused to investigate wrong doings by the USCF contractors and members of the board majority. - The board majority refused to investigate leaks of confidential information as well as the "unauthorized secret negotiation" between Jerry Hanken and Sam Sloan using confidential board information in the middle of a lawsuit. - The board majority refused to open up all records for independent investigation. The USCF is losing money and we have financial problems. Instead of focusing on promoting the USCF positively to gain more members and raise much needed revenues, you want to focus on this complete garbage. But if this is the game you want to play, you may as well vote to remove my title as Chairman as well. If this board passes this motion to remove Paul and not me, I will also step down as Chairman since I am involved in this legal situation just like all seven members of the board including you. I will help you publicize your votes since I am sure you want all members to know about your plans. While you are at it, do you want to vote to exclude us from the board meeting tomorrow and Sunday? What is next? You cannot have a double standard unless you know something I do not. Susan Polgar In a message dated 2/1/2008 5:05:39 P.M. Central Standard Time, randybauer2300@xxxxxxxxx writes: Committee members, Given the current legal issues surrounding Paul and the USCF, I make the following Committee motion and vote yes: I move that the Committee recommend that Paul Truong's title as Vice President Marketing and Communications be removed. I further move that the Committee recommend that Paul Truong be removed as liaison to any and all board or delegate appointed USCF committees. Randy Bauer Who's never won? He never did. In fact, no one did. All we got was an email confirming that he received the evidence. There has been absolutely no communication since. Even after I said that we could provide more evidence if needed, no one asked. This is exactly what I have stated repeatedly. I have not questioned your character. I just believe that you made a series of wrong decisions which will effect the future of this federation. I hope that I am wrong. However, I do strongly question the motives of others. If you take no joy on being on the board then please feel free to resign. After seeing how some board members have behaved in the past few months, I strongly feel that I must fight this all the way for the sake of this federation and its members. They deserve better. Susan Polgar In a message dated 2/1/2008 11:14:36 P.M. Central Standard Time, randybauer2300@xxxxxxxxx writes: Susan, Mr. Kronenberger, a well established attorney with a national reputation, has advised us that what was sent to him was NOT "more than enough to show that the report had the wrong conclusion." He has no "dog in this fight" and I will continue to guide my actions as an officer of the USCF based on his, not your, counsel. I have no "plans" other than to hope that the USCF survives this very unfortunate period. I have a pretty good idea what really caused it, and I am confident that I had nothing to do with it. Given that I have absolutely NO plans to serve on this Board past the term for which I was elected, I assure you publicizing my actions in the way that you tend to characterize actions of others will have no effect on me. Randy Bauer I was asked not to do so by members of the Committee. Believe me, I take no joy in any role on this Committee or the Executive Board, for that matter. Susan, if you and Paul want to step down from the Board in return for my stepping down, I will do it immediately. That said, if you and Paul wish to continue in your roles on the Executive Board, then I will do so as well. In fact, we suggested for you to be the committee chair. However, once the fiasco with the NY Times situation took place, I no longer feel that you can be on the subcommittee. The conflict is quite simple. You did something that affected the personal, professional and financial welfare of your fellow board members. You repeatedly denied that you did anything wrong when I clearly told you that I could document the time line of what took place. You then later apologized for your misconduct which is commendable but the serious damages already occurred. Your actions potentially created new legal problems for the USCF and I strongly feel that you should no longer be in the position to influence the outcome. Once again, I sincerely hope that you will agree to step down from the subcommittee to avoid any potential conflict of interest. Susan Polgar In a message dated 2/1/2008 11:44:23 P.M. Central Standard Time, randybauer2300@xxxxxxxxx writes: Susan, On your chess blog you wrote that I have a conflict of interest. Do you understand what you are implying? Conflict of interest means that I may be acting for my own benefit rather than the Federation's. What on earth leads you to that conclusion? What on earth leads you to think this is not potentially damaging to me in terms of my professional and personal reputation? You know, I am a public figure too and have a multi-million dollar business plan that relies on people believing in my character and credibility. You, too, need to take greater care in how you write about others in public forums. I will also not allow my reputation to be smeared. These are two way streets. Randy Bauer Who's never won? I also did not say that your repeat denial that you did nothing wrong then later admitted that you made a horrible mistake is a conflict of interest. Both were errors in judgment. Nevertheless, they were serious errors which affected others in a number of ways. Because of your series of mistakes, you potentially created new legal problems for the federation and yourself and I strongly feel that you should no longer be in the position to influence the outcome which could affect you. Due to the extremely sensitive nature of this matter which is not helping the USCF whatsoever, there is no reason to make things more heated by staying on the subcommittee when it is best to avoid any possible conflict of interest. Even your own attorney recommended that the subcommittee could have 3-5 members as you mentioned during the meeting in Crossville. There is no need to have all 5 members. When this was initially brought up, you immediately agreed to step down. This could potentially help resolve this mess a lot faster which would be in the best interest of the federation. I hope you will still agree to do so. You have the last word. Susan Polgar In a message dated 2/2/2008 12:21:21 A.M. Central Standard Time, randybauer2300@xxxxxxxxx writes: Susan, What you describe may have been characterized as an error in judgement. It is NOT a conflict of interest. You should consult an attorney as to the meaning of the phrase and the possible ramifications of your claims. Your choosing to describe it as such - and continuing to leave it on your website -- is documented. "Conflict of interest" could easily be taken to mean "a closed-minded interest in defending a past decision contrary to evidence". It just seemed surprising that she didn't flash on the possibility that the phrase had a more technical meaning (and use Google to see what that meaning was) when the other party so obviously boggled at the charge. |
