George I happen to know exactly what the law is on this subject. The law is that when the terms are doubtful or ambiguous, the courts look to legislative intent. The reason I know this is that this was the exact issue in my case in the United States Supreme Court which I won 9-0. http://www.samsloan.com/sec.htm I interpreted the statute one way. The SEC interpreted the statute another way. The court decided that I was right and I won. In the case presented here, the issue concerned the 1997 US Open in Orlando, Florida. Goichberg was the organizer. After his bid had been accepted, Goichberg asked that both the prizes and the entry fees be raised. This was done more than one year before the event took place. Goichberg was then elected to the board. Dorsch complained about conflict of interest. Dorsch had been entrusted to re-write the by-laws, so Dorsch inserted this provision for the purpose of making what Goichberg did illegal. These by-laws were adopted in 1998 in Hawaii. At no time has this provision ever been intended to stop books and equipment vendors from selling books and equipment to the USCF. Therefore, George John's interpretation of this provision is entirely bogus. Sam Sloan |
