WRIT OF MANDAMUS

1. To the Honorable Judge of Said Court: Her majesty, Queen Elizabeth
II, alleges through Marcus Wayne Roberts, a citizen of the United
States of America and the Federation of St Christopher and Nevis (or
St Kitts and Nevis) the Queen's REGENT-IN-FACT as head of State of St
Kitts and Nevis, as follows: due to of a grant of diplomatic immunity
for alleged official acts (2,500 alleged absence emails to thwart a
coup-de-ta) as her Ambassador in time of war (or former Ambassador)
for the Federation of St Kitts and Nevis , that Marcus Wayne Roberts
is unable to obtain a US passport card illegally for reasons US
National Security. Secretary Clinton wishes to PREVENT St Kitts and
Nevis form maintain normal diplomatic relations with other nations.
2. No jury trial can be asked for reasons of US National Security. The
jury will be denied evidence by the US State Department. The jurors
will be threatened or killed for reasons of US National Security
3. Roberts diplomatic acts have cost him his ability to get a US
passport card or second passport after 3 attempts or application. Her
majesty alleges that has been attempted with official assassination by
the US Department of State for failure to produce documentation of
immunity grant, that Roberts is in fact wanted on felony political
charges in Russia, that Roberts has never traveled to Russia, and that
Secretary of State Hillary Clinton intends to KILL Marcus Wayne
Roberts, by tricking him into travel to Russia, or travel to a state
that will extradite Roberts to Russia. Marcus Wayne Roberts asks for
unspecified punitive damages, 5,000 (five thousand) dollars in legal
fees paid to Florida lawyer Neil Rambana, and 350 dollars in filing
fees. Mr. Roberts asks for a WRIT ordering the production of a US
passport card and second US passport. The documents Roberts seeks
could allow Roberts unofficial, normal travel, and normal life as a US
citizen.
INTRODUCTION

4. Plaintiff, Mr. Roberts, applied for United States Passport based
on this birth in the United States of America, specifically Florida.
Plaintiff is eligible for a US passport card and second passport
pursuant to 22 U.S.C. Section 2705. Plaintiff needs second passport
for VISA reasons, certain diplomatic missions hold passports for VISA
processing for extended periods of time. Roberts intends to travel
officially as an Ambassador with his US passport to protect his right
of US consular protection.

5. Plaintiff filed suit to obtain a second US passport and Passport
Card February 20, 2009. Secretary Clinton then engineered a smear
campaign, causing Roberts home to be searched, his computers taken,
firearms pointed at him by police officers not in Uniform 4:09cv75-RH/
WCS. (Roberts v. United States Department of State, et. al). Roberts
asks for all evidence introduced in the Florida suit to be
reintroduced in this case. Roberts can't file the evidence due to a
lawsuit against the Clerk of the Court in the Western District of
Texas. Clinton personally ordered the search. Search was conducted by
the Calhoun County Sheriff's Department, with a personal threat
verbally issued by a law officer not to engage in diplomatic acts
which "harm the United States of America." Clinton intends to kill
Roberts.



JURISDICTION

6. This is a civil action over which this Court has jurisdiction under
28 U.S.C. 1331 (federal question). This court does NOT have
jurisdiction over defendant Sheriff Tatum, unless he consents,
however, the only remedy is the United States Supreme Court, under
Rule 17. Tatum might simply prefer to send plaintiff his property back
undamaged, and Plaintiff will release Tatum from this lawsuit, and any
past liability for assassination attempts if Tatum releases Roberts
also from any past liability. Jurisdiction also comes from 28 U.S.C.
1346(a) (actions against officers of the United States) 28 USC 1361
(WRIT OF MANDAMUS to compel and officer of the United States to
perform a duty owed to the Plaintiff) 28 USC 2201-2202 (Declaratory
Judgment Act) 5 U.S.C. 701 et seq (Administrative Procedure Act- to
compel agency action unlawfully withheld or unreasonably delayed) and
5 U.S.C. Section 2412(d) (Equal Access to Justice Act). Jurisdiction
also comes from the fifth amendment of the US Constition.

VENUE

7. Venue is proper for Clinton and the State Department under 28 USC
1931(e) and lies in the Western District of Texas, El Paso. El Paso is
the closest courthouse to plaintiff's 3 acre homestead, 19308 France
Silva Ave, El Paso, Texas 79938. Venue is not proper for defendant
Tatum, unless he consents. However, Tatum can simply return Roberts
diplomatic property, and Tatum will be discharged.

PARITIES

8. Plaintiff is Marcus Wayne Roberts, 19308 France Silva Avenue, El
Paso, Texas 79938. Mailing address for US mail is PO BOX 961029, El
Paso, Texas 79996.

9. Defendant Hillary Clinton is Secretary of State of the United
States of America. Clinton is sued in her official capacity.

10. Defendant Department of State issues passports and passport cards,
and maintain secret records about plaintiff.


FACTS

11. Roberts has filed THREE applications for a US passport card and
second US passport.

12. The first set of passport and passport card applications was in
(approximately) September of 2008.

13. The second set of applications was made on December 5, 2008 and
December 12, 2008. Letters were sent on December 12, 2008 and January
20, 2009, from the US Department of State, informing him that he will
need to complete the enclosed citizenship questionnaire. The
questionnaire must be notarized and returned to this office as soon as
possible. Plaintiff declines to answer questions about his citizenship
by birth and takes the fifth amendment on questions about his actions
as an ALLIED or NATO Ambassador.

14. The third set of applications was made in July of 2008 from 1301
Rodd Field Rd, Apt 202, Corpus Christi, Texas 78412. US mail forwards
are in effect. The third set of applications were totally ignored or
lost in the US mail.

15. Plaintiff requests second US passport and passport card to be sent
to PO BOX 961029, El Paso, Texas 79996.

CAUSES OF ACTION AND RELIEF

16. Plaintiff brings this complaint for mandamus, declaratory, and
injunctive relief to compel the US State Department to issue him a
second US passport and US passport card and enjoining him from
answering "Determination of Possible Loss of U.S. Citizenship.
Plaintiff AFFIRMS his US citizenship.

17. An order awarding the Petitioner his attorney's fees and costs
involved in brining this lawsuit under the Equal Access to Justice
Act, 5 USC 504, 28 USC 2412(d), and 42 USC 1988.
Plaintiff seeks unspecified damages from the State Department from
keeping his Russian and Swiss arrest warrant information secret. The
denial of this information could kill Marcus Roberts in a foreign
prison. Roberts would never escape Russia, and the State Department
intends to trick him into travel to Russia or to engineer an emergency
plane landing to kill Roberts in Russia. Roberts seeks unspecified
punitive damages.

18. Plaintiff intends to amend this complaint after discovery.

19. Plaintiff OBJECTS to Judge Martinez as judge, and will disqualify
him if he intends to ENTER in this CASE.
