If Chess HQ folds, as Bruce Draney fears, it might be wise for the EB to
have in place now a plan to determine who will administer the ratings database. Whatever entity gains authority over that database will be in the strongest position to build a new federation around it. Lacking a formal plan of action, my guess would be that the ratings would end up in the hands of Bill Goichberg, who in my opinion would be the most competent caretaker until the smoke cleared. If the ratings database is considered an asset, then the USCF might not have much of a say about what happens to it in case of bankruptcy. It would be sold by the bankruptcy court. Would the Life Members qualify as creditors? -- Charles Allen |

At best they would be at the end of the line of unsecured creditors along with dues-paying members, who would still be owed services for the balances of their memberships as well. If the USCF is forced into bankruptcy by secured creditors, the odds of there being much left for unsecured creditors is pretty mimimal. I'm not sure how voluntary reorganization works for not-for-profit organizations, but I suspect that in such a reorganization the members, including life members, would get left out. -- Mike Nolan |
