Default USCF Opposition to Ex Parte Motion

PLAINTIFFS UNITED STATES OF AMERICA CHESS FEDERATION, INC. AND RANDALL
D. HOUGH’S OPPOSITION TO POLGAR’S EX PARTE MOTION TO STAY DECISION

Plaintiffs UNITED STATES OF AMERICA CHESS FEDERATION, INC. (“USCF”) and
RANDALL D. HOUGH (“Hough”) hereby oppose Defendant Susan Polgar’s Ex
Parte Motion to Stay Decision on Her Motion to Disqualify Pending
Transfer to the Northern District of Texas or Decision on Motion to
Compel [D.E. 243] (the “Motion”).

ARGUMENT

The Court denied Defendant Polgar's ("Polgar") motion to disqualify
counsel at the September 28, 2009 hearing. Polgar seems to take the same
position, as she moves to stay the Court's decision with her filing
yesterday. [D.E. 243]

Polgar's Motion is tantamount to a request that the Court reconsider its
order. However, Polgar has not complied with the local rules regarding
requests for reconsideration. (L.R. 7-9.)

As Polgar raises no new issues in her motion (as required by L.R.
7-9(b)(1-3) for a motion to reconsider), there is no need for the USCF
to provide further briefing.

CONCLUSION

For the foregoing reasons, the Court should deny Polgar’s Motion.
Further, the Court should clarify, by means of a minute order, that
Polgar’s motion to disqualify was, as stated at the September 28, 2009
hearing, denied with prejudice.
