Default Finally, at long last, the USCF Sues to Remove Polgar and Truong

The USCF has filed suit in Illinois State Court to remove Polgar and
Truong. The USCF is incorporated in Illinois, which is the reason why
this suit was filed there.

Although filed only yesterday, the complaint has already been posted
on several websites, including:

This lawsuit seeks findings from the court that Susan Polgar and Paul
Truong have engaged in dishonest and fraudulent conduct. The lawsuit
also seeks court orders removing the two of them from the USCF
Executive Board and prohibiting them from running for re-election.

This complaint could have and should have been filed a year ago, when
it became apparent that Polgar and Truong had committed massive fraud
upon the USCF and its members. At least, by waiting a year, now the
USCF has proof positive that Polgar and Truong are the guilty parties,
as a result of serving subpoenas on their ISPs which provided proof
that the account holder of the account that made some of the "Fake Sam
Sloan" postings was Paul Truong and that the account was paid for with
Susan Polgar's credit card. In addition, as a result of subpoenas
served on the ISP for chessdiscussion.com and other ISPs, the USCF has
proof that Susan Polgar and an accomplice (known to be Gregory
Alexander) stole the password of Board Member Randy Hough and hacked
into his email account at least 111 times, thereby obtaining
confidential information.

Already, after reading the USCF's complaint, the last of the long time
Polgarites are abandoning her.

A long time Polgar supporter writes:

"I have never been so disappointed in anyone in chess as Polgar. I
really really hoped that she was who she seemed to be."

Another former Polgar supporter writes:

"I had been a strong supporter of Susan Polgar for a long time ... I
no longer support Susan Polgar or those she supports in USCF
politics."

This suit comes just in time. As recently as yesterday, there were
reports that Susan Polgar was offering deals to get candidates to run
on the Susan Polgar Slate in the coming USCF election, and was also
offering deals to possible opponents if they agreed not to run.

The smartest thing :Polgar and Truong could do now is resign for the
board and head for the hills.

The tricks they have used or tried to use in the other cases will not
work in this case. They cannot evade service of process, because they
can be served by service on the USCF, since they are directors of the
USCF.

They cannot complain that the Illinois court has no jurisdiction,
because it clearly does have jurisdiction. They cannot file a
retaliatory lawsuit in this case. Refusing to testify will not work
either.

I cannot see any defense they could possibly have.

They had better be worried about being deported if this case goes to
judgment, especially since Susan Polgar has apparently never bothered
to become a US citizen, and since the complaint contains allegations
of crimes of "moral terpitude", which are deportable offenses.

Donna Alarie is now giving aid and comfort to Susan Polgar and Paul
Truong, no doubt leading them to believe that they can beat this
thing.

They cannot beat this thing.

The tricks they have used or tried to use in the other cases will not
work in this case. They cannot evade service of process, because they
can be served by service on the USCF, since they are directors of the
USCF. They cannot complain that the Illinois court has no
jurisdiction, because it clearly does have jurisdiction. They cannot
file a retaliatory lawsuit in this case. Refusing to testify will not
work either.

I cannot see any defense they could possibly have.

As to the timing of this suit, it takes time for lawyers to do the
research and prepare and draft a complaint, especially one dealing
with novel issues as this one does. One does not just run down to the
court house and file a case as soon as evidence emerges. I wish they
had filed this case a lot sooner, but I am glad that they did finally
file it.

As to the fact that it was filed just before the beginning of the
election period, think of how much worse it would have been if it had
been filed during the election period.

If Donna wants to help Paul and Susan, she will help them best by
advising them to resign. That would be the best thing for them, and
the best thing for the USCF.

Prolonging the struggle will only make things much worse for Paul and
Susan in the long run.

I have heard exactly exactly the same rumor or report.

Of course, I do not know if I heard it from the same source that Hal
Bogner heard it from, but it is obvious that a lot of people have
heard this in the last two days.

There is nothing in the Rules of the USCF Issues Forum against posting
rumors or reports. Several members of the USCF Issues Forum have
called for the above posting by Hal Bogner to be removed. Of course,
in the past, moderators have frequently removed these sort of
postings, but that does not mean that that were following the rules.

Again nothing to do with chess computers, so why its posted to
rec.games.chess.computer I do not know. But you have never chosen to
answer my conserns before, so I guess you will ignore them again.

In the case of Susan Polgar's husband, Paul Truong, I can see that there
is overwhelming evidence he made the fake posts. This is substantated
with detailed analyis of IP addresses etc, using expert witnesses.
Although I have not read in much detail, the information presented does
indicate he mis-behaved. (BTW, I am not a laywer).

In the case of Susan Polgar herself, there are a lot of accustations,
but no proof. No explanation of how she got the password to access the
email account she is supposed to have been able to read. No IP address
information showing the account was accessed from a computer she owns,
or has access to. I do not know if the particular email provider gives
you the last time someone logged in, but if so, then the owner of the
account should have known.

I live in the UK, but know a US citisen how knows you. I will not give
his name, but he says you are a 'bit of a nutter' but admits when you
make an accusation, you are normally right. I can't help feeling you
would get more respect by not posting to so many news groups, sticking
to facts, with less sensationalism.

who saw Ferris pass out at 31-Flavors last night.

I guess it's pretty serious.
