Default Revised Settlement Proposal

1. All legal actions are discontinued with prejudice.

2. All parties, including Paul Truong, exchange mutual general releases
from all claims.

3. Polgar and Truong serve out their respective terms on the EB provided
a. That Lugo, Hecht and Korenman withdraw from the USCF elections;
b. Polgar and Truong agree to take no part in management and/or
governance of the USCF for a period of 5 years subsequent to the end
of their current terms.

4. a.Polgar and Truong agree to close chessdiscussion and not maintain
any similar discussion site, or
b. Such site(s) is OK if posters are known and verifiable.

5. Polgar and Truong agree that no anonymous posters will be allowed to
comment on any web site owned and/or controlled by them, their agents or
assigns.

6. A liquidated damages clause (penalty to be determined) in the event
the agreement is violated by any party to the agreement, with the
determination of said violation to be heard by binding arbitration
before the American Arbitration Association.

8. Possible gag order restricting personal comments by parties to the
agreement on other parties to the agreement.

We'll just have to disagree. Settlements rarely make everyone happy.

How could this become binding on these three people? So far, they
have no formal part in the litigation.

Given the big part that fake identities have played in this whole
mess, how could this be enforced, given that the fakers have become

As to what to do legally, I leave to lawyers, and I have no idea how
this will play out. I do wonder how Lafferty can have made all the
claims that what the rest of us believed was just the tip of an
iceberg, that huge, much more serious new revelations about Truong
were coming out soon - and then propose a settlement in which he gets
off without any punishment whatsoever.

This proposal introduces a new level of 'control' at USCF. Now USCF
needs to have a watchdog committee on websites that might possibly
have a connection to someone in USCF. This is just what USCF does NOT
need - control of information, opinion, and debate.

Of course it would not be binding on them, but in view of the fact
that they are running because Susan Polgar called them and asked them
to run, plus the fact that they are virtually unknown in the world of
chess and have no chance to be elected without Susan's support, I
believe that a simple phone call from Susan asking them to drop out
would be sufficient.

there, on my behalf, please do so because as you know I am blocked

That's because he's a politician, and not the agent of reform that
he's posed as here and elsewhere.

I have never met Lugo or Hecht, and I do not presume to speak for
Korenman.

If elected, one can count on Mr. Korenman (endorsed by Polgar &
Truong) to perform his fiduciary duty. Mr. Korenman does not
particularly want to be elected.

Randy Bauer (previously endorsed by Polgar & Truong) has performed his
fiduciary duty with respect to the current mess.

The idea that Polgar & Truong, who have utterly no sense of fiduciary
duty, be allowed to stay on the board, and that Mr. Korenman, utterly
blameless in the current matter, be forced to withdraw his candidacy,
speaks again to Mr. Lafferty's character.

Because this has no effect on the criminal matters being pursued by the
US Attorney in CA and the US Attorney in Brooklyn. They will still have
to deal with that.
